A. Withdrawal Policy

Introduction

Consumers have a right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the last goods.

You may use the attached model withdrawal form for this purpose, although this is not mandatory.

You may also exercise your right of withdrawal online via the website at the following address: https://shop.legatumnoctis.com/apps/widerruf. If you use this online function, you will immediately receive an acknowledgment of receipt on a durable medium (e.g. by email), containing information about the content of your withdrawal declaration as well as the date and time of its receipt.

To comply with the withdrawal period, it is sufficient for you to send the notification concerning the exercise of your right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract.

For this reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired.

You shall bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods if such diminished value results from handling of the goods that was not necessary to inspect their nature, characteristics, and functionality.

Exclusion or Early Expiration of the Right of Withdrawal

The right of withdrawal expires prematurely for contracts for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.

Unless otherwise agreed, there is no right of withdrawal for contracts concerning the provision of services related to leisure activities if the contract provides for a specific date or period for the provision of the service. Accordingly, there is also no right of withdrawal for contracts concerning the sale of tickets for leisure events scheduled for a specific date.

General Information

1. Please avoid damaging or contaminating the goods. Please return the goods to us in their original packaging together with all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.

2. Please do not return the goods to us postage due or freight collect.

3. Please note that the above points 1–2 are not a prerequisite for the effective exercise of your right of withdrawal.
